Welcome to Fundly (“we,” “our,” “us”). By accessing or using our website, mobile applications, or services (collectively, the “Platform”), you agree to be bound by these Terms of Use (“Terms”). If you do not agree, please discontinue use immediately.

These Terms apply to all visitors, donors, campaign organizers, and other users (“you,” “your”).

1. Eligibility

  • Be at least 18 years old (or the age of majority in your jurisdiction) to create a fundraiser.
  • Use the Platform only for lawful purposes.
  • Provide accurate and complete information during registration.

If you are using the Platform on behalf of an organization, you represent that you have legal authority to bind that organization.

2. Our Services

Fundly provides online tools to help individuals and organizations create and share fundraising campaigns. We are not a bank, financial institution, or charity. All donations are processed by third-party payment providers.

3. Account Registration & Security

You are responsible for maintaining the confidentiality of your account login details.

  • Notify us immediately if you suspect unauthorized account activity.
  • Do not share your account credentials with others.

We are not liable for losses due to your failure to safeguard your account.

4. Fundraisers & Campaign Content

  • All information is accurate, truthful, and not misleading.
  • You have legal rights to use any text, images, or videos uploaded.
  • You will use funds raised only for the purpose stated in your campaign.

We reserve the right to suspend or remove campaigns that:

  • Contain fraudulent, hateful, or illegal content.
  • Violate intellectual property rights.
  • Mislead donors or misrepresent causes.

5. Donations & Payments

  • Donations are processed through secure third-party payment providers.
  • Fundly does not guarantee that you will receive any specific amount.
  • Transaction fees may apply and will be disclosed before payment.
  • Donations are generally non-refundable unless required by law or if a refund is approved under our Refund Policy.

6. Taxes

We do not provide tax or legal advice. It is your responsibility to determine whether your campaign is eligible for tax-deductible status and to comply with all reporting obligations.

7. User Conduct

  • Engage in fraudulent or deceptive activity.
  • Harass, threaten, or abuse other users.
  • Upload viruses or malicious code.
  • Use the Platform for illegal purposes, including money laundering.

8. Data Privacy & Protection

We respect your privacy and handle your data in accordance with our Privacy Policy.

  • EU/UK users are protected under the GDPR.
  • California users are protected under the CCPA.
  • We implement industry-standard security measures but cannot guarantee complete protection against unauthorized access.

9. Intellectual Property

All Platform content (excluding user-generated content) is owned or licensed by us and protected by copyright, trademark, and other laws. You may not use our content without permission.

10. Accessibility

We strive to make our Platform accessible in compliance with the ADA and WCAG 2.1 AA guidelines.

11. Limitation of Liability

To the maximum extent permitted by law:

  • We are not liable for indirect, incidental, or consequential damages.
  • Our total liability is limited to the greater of $100 or the amount you paid to us in the 12 months prior to the claim.

12. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your use of the Platform or violation of these Terms.

13. Termination

We may suspend or terminate your account at any time for violating these Terms or for conduct harmful to the Platform or its users.

14. Governing Law

These Terms are governed by the laws of the State of California, USA, without regard to conflict of law principles.

15. Changes to These Terms

We may update these Terms from time to time. Continued use after changes means you accept the revised Terms.
